The Polish Ministry of Health intends to ban the sale of disposable e-cigarettes and flavored nicotine bags, and completely ban the sale of e-cigarette products to people under the age of 18. According to Portalsamorzadowy on May 7, Polish Deputy Minister of Health Wojciech Konieczny announced at a meeting of the Parliamentary Health Committee on May 7 that the government has prepared a draft legislation to ban the sale of disposable e-cigarettes and nicotine bags with flavoring ingredients. The draft has been approved by the Government Program Arrangement Working Group (zespół do spraw programowania prac rządu).


According to the deputy minister, the proposal will also explicitly prohibit the sale of all types of e-cigarettes to minors under the age of 18, and impose additional restrictions on products currently on the market that are not yet covered by existing regulations.


The Polish Parliament's Health Committee voted unanimously on the draft bill. All 31 members present voted in favor of the draft bill, with no one opposing and no one abstaining. The committee members unanimously decided not to propose amendments.


According to the relevant EU legislative coordination procedures, if the draft is modified, it will need to be resubmitted to the European Commission for a three-month technical notification (notyfikacja techniczna). According to the Ministry of Health, the regulation prohibiting the sale of all e-cigarettes to people under the age of 18 is specifically intended to be implemented before the summer vacation.
